As you may know, on January 25, 2013, the Office for Civil Rights (“OCR”)
published Omnibus Final Rule which implements changes to HIPAA required by the
HITECH Act of 2009 and the Genetic Information Nondiscrimination Act of 2008
(“GINA”). These changes may render some sections of Frequently Asked Legal
Questions out of date, especially Chapter 15: HIPAA, HITECH, and State Law:
Patient Information (which consists of 19 out of 189 total questions in the
book) and Appendix 13: HIPAA “20 Questions.” While these sections, along with
other HIPAA references, should be disregarded in light of the recent changes,
the other information in the book remains current.
